The Australian Government has announced plans to establish a specialist Fair Work Court, aimed at creating a simpler, faster and more cost-effective process for resolving workplace relations disputes.

The proposed court is intended to work alongside the Fair Work Commission, with specialist judges experienced in workplace relations presiding over matters. The Government’s objective is to reduce delays and improve access to justice for both employees and employers, particularly in relation to wage underpayments and employment disputes.

What does this mean for employers?
While the Fair Work Court has not yet been established and consultation on its design is still to occur, employers should be aware that the proposal signals a continued focus on:
  • Faster resolution of workplace disputes.
  • Increased scrutiny of wage compliance and employee entitlements.
  • Greater accessibility for employees seeking to pursue employment-related claims.
  • A more specialised forum for workplace litigation.
If implemented, businesses may see employment disputes progress more quickly through the legal system, reinforcing the importance of ensuring compliance with workplace laws and maintaining robust employment practices.

What should employers do now?
Although there are no immediate changes to employer obligations, now is an ideal time to review:
  • Payroll and wage compliance.
  • Employment contracts and classification of employees.
  • Record-keeping practices.
  • Policies and procedures.
  • Processes for managing workplace disputes before they escalate.
Taking proactive steps now can significantly reduce the risk of future claims and ensure your organisation is well positioned should the new court proceed.
