The Fair Work Ombudsman has issued a strong reminder to employers: job ads must comply with minimum pay laws, and failure to do so comes with real consequences.
In 2024–25:
Over 318 fines were issued
Penalties exceeded $111,000
Many cases involved pay rates advertised below legal minimums
What Employers Must Do
When advertising roles, employers must ensure:
The rate of pay meets the relevant Award, Enterprise Agreement, or National Minimum Wage.
The job ad does not mislead or imply reduced entitlements.
Visa holders are not treated differently—all workers have the same rights.
